Graham Bill To Restrict Use and Sale of Dangerous Fireworks in DC

Washington, DC – Councilmember Jim Graham (D-Ward One) introduced a bill today to restrict the use of fireworks in the District of Columbia and to prohibit fireworks sales.

The bill requires a permit for the display of fireworks and provides a civil penalty for illegal possession or use. The bill also provides a civil penalty for the sale of fireworks.

In 2005, an estimated 10,800 people were treated in U.S. emergency rooms for fireworks-related injuries. During the months surrounding Independence Day, about 45% of the injuries were sustained by children 14 years and younger.

“Fireworks not only lead to injuries,” said Councilmember Graham, “but fireworks disturb the peace and order in our neighborhoods.”

Councilmember Graham introduced a similar bill in 2004 with then Councilmember Adrian Fenty (D-Ward Four).

According to the National Fire Protection Association and the Center for Disease Control, the safest way to enjoy fireworks is to leave fireworks displays to professionals.

Although some fireworks are currently allowed in the District, most are prohibited. For example, fountains and sparklers less than 20 inches are allowed. Fireworks that are not allowed under current law include bottle-rockets, firecrackers, cherry bombs, roman candles and fireworks with a side fuse. The possession or use of an illegal firework is subject to penalties up to $1,000 or arrest.
